Diamo enduros street legal in California?

According to www.lsmotorsports.com who feature their Diamo brand, their enduro is EPA/DOT/CARB legal for on-road use in all states (including California, according to them). Does anyone know if this is true or not, or just a little stretch of the truth?

OVERVIEW
